Q: If I am not going to draw a full Social Security disability check while I collect weekly Workers’ Compensation benefits, should I still consider applying for Social Security disability?

A:

Yes, claimants receiving weekly Workers’ Compensation benefits should consider applying for Social Security disability.  You are entitled to receive Workers’ Compensation benefits only when you are unable to return to your old job.  This question – whether or not a claimant can return to work – is a common source of dispute between an injured worker and an insurance company.  It is strong evidence that a claimant cannot return to work when he/she is approved for Social Security disability.  This approval is similar to the government stating there are no jobs that a claimant can return to.  There are very rare and particular circumstances when it may be beneficial to wait to apply for Social Security disability, but it is almost always a good idea to apply as soon as possible.  Attorneys who practice in these areas will advise you if it is in your interest to wait.
